Awakening of Love Terms & Conditions to Agreement and Process Ground Rules

Please read the following Terms & Conditions and Process Ground Rules. They form part of the agreement which you enter into with us. If you have any questions before agreeing to the Terms & Conditions, please contact the Awakening on the Path organizer who sent you this document. We will always discuss and address any concerns you may have. DO NOT SIGN THESE TERMS AND CONDITIONS UNLESS YOU ARE IN AGREEMENT WITH THEM.

References in these Terms & Conditions to “Awakening on the Path” or to “we”, “our” or “us” in each case refers to POL Global Foundation Ltd. References to “you” or “your” are to you, the participant on the Awakening on the Path Process (which we also refer to as “the Process” and “the course” and/or “the programme.”). These Terms & Conditions are the exclusive basis for the contract between you and us. No other terms or conditions (whenever and however communicated), nor any amendment or addition to these Terms & Conditions, will apply unless agreed by a director of POL Global Foundation Ltd in writing.

Confidentiality Agreement

You understand and agree that the Awakening on the Path Process, including the pre and post-Process material, is a private and personal experience for each participant, and that the processes constitute Intellectual Property, are proprietary and copyrighted, and are owned by POL Global Foundation Ltd. As such, you agree to respect the confidentiality of all participants and their remarks and actions, the processes themselves; you agree to keep all such information private and confidential; and, to make no use or dissemination of the Processes without the written permission of POL Global Foundation Ltd. Materials presented are intended solely for Process use. You are not permitted to duplicate, resell, modify and resell, and/or repackage and resell, and/or rename and resell the materials. Materials or any part of them are not to be used in connection with any seminar, training programme, therapy, process, consulting, or other business activity except the Awakening on the Path process. This agreement supersedes any prior agreements you may have regarding material use. By signing these Terms & Conditions, you agree to be bound beyond copyright law.

You also agree to respect the confidentiality, identity and experience of all Awakening on the Path participants and staff, and not to reveal or disclose same. You accept that photography, video and sound recording are not permitted at the venue during the Process week.

Process Ground Rules

These rules are for your safety and to ensure that you, and the rest of the participants, gain the most from the course.

  • You agree that all forms you submitted were (and remain) true and complete, and that you did not omit anything relevant.
  • The use of drugs, alcohol and other mood altering drugs is prohibited, nor can these be brought to the venue. You must notify us before the course of prescribed medication.
  • You agree that you are not active in any eating disorders during the Process.
  • You are responsible for your wellbeing; including getting sufficient food and sleep during the Process and taking any prescribed medicines on time.
  • If at any time you feel unwell you agree to let a member of the Awakening on the Path Staff know, and they will give you the support that you need at the time.

Warranties

No warranties of any kind or nature are given by POL Global Foundation Ltd.

Disclaimer, Release and Indemnity

POL Global Foundation Ltd disclaims all liability for any illness, injury, death, property loss, or damage suffered by you directly or indirectly caused by negligence or breach of contract, breach of duty, or breach of statutory duty by POL Global Foundation Ltd and its members, Process leaders, staff members, employees, organizers, and agents (Releasees) which occurs while you are participating in the Process, to the extent permitted by applicable law.

You understand and agree that the Process is an intensive inner exploration. You acknowledge that when you participate in the Process, you do so at your own risk, and you acknowledge that while you are participating in the Process or at the location of the Process, you assume the risk of, and the responsibility for, any injury or illness that you suffer, death or property damage or loss however such injury, illness, death, loss, or damage may occur, to the extent permitted by applicable law.

You agree to release and indemnify the Releasees against all and any liability or claims arising out of or in connection with any illness, injury, death, property loss, or damage that you may suffer or incur directly or indirectly caused by the negligence, breach of duty, breach of contract, or breach of statutory duty by the Releasees, or in any way whatsoever, while you are participating in the process or present on the premises where the Process is conducted to the extent permitted by applicable law.

You release, and will indemnify and hold harmless the Releasees against all and any actions or claims which may be made by other parties arising out of or in connection with any illness, injury, death, property loss, or damage suffered by other parties as a result of your negligence, breach of duty, breach of contract, breach of statutory duty or otherwise to the extent permitted by applicable law.

This release, waiver and indemnity will bind your heirs, executors, personal representatives, and assigns.

You agree to indemnify the Releasees for any liability and cost which we may incur as a result of any breach by you of these Terms & Conditions (including, but not limited to, either of the two clauses headed “Proprietary Materials” and “Confidentiality Agreement”) to the extent permitted by applicable law.

Cancellation Policy

Prices quoted by us indicate the cost of all course materials and include any relevant taxes.

  • Cancellation policy for Awakening on the Path is determined by the regional Awakening on the Path Organizer.  This includes any late cancellation fees and policies.
  • All cancellations must be submitted in writing.
  • If you are asked to leave the Process for breaching these Terms & Conditions, or if you are in breach of our Process Ground Rules, no part of the course fee will be refunded.
  • If you suffer from sudden ill health, or recent bereavement, please contact POL Global Foundation Ltd immediately in writing. Your course fee can be suspended until a suitable alternative date can be found. Refunds may be considered if a medical certificate is provided.

POL Global Foundation Ltd will make every effort to provide the programme as agreed. However, we reserve the right to alter or cancel the venue or date of a course, for any cause beyond our reasonable control. In the very unlikely event that a course is cancelled, you may receive a full refund of monies paid to us. Our liability will be limited to that refund and the POL Global Foundation Ltd. will not be liable for any other direct or indirect loss, cost or expense, of any nature, however caused.

Law and Jurisdiction Applicable

These Terms & Conditions, and all other parts of the contract between you and the POL Global Foundation Limited, are governed by the law of the United Kingdom. Exclusive jurisdiction over any action or claim arising out of or in any way related to the Agreement to participate and participation in the Awakening on the Path shall be in the Courts of the United Kingdom nearest the offices of POL Global Foundation Limited.

All Provisions Negotiable and Accepted

All of the Terms and Conditions stated above are subject to negotiation and discussion. By signing these Term or Condition, the participant waives any and all objections to such Terms and Conditions, and accepts all of the Terms and Conditions as stated.

Severable Terms

If any provision(s) of these Terms and Conditions is found to be unenforceable, all the remaining Terms and Conditions shall remain in full force and effect.

Entire Agreement

This Agreement constitutes the entire agreement and understanding between you and us. This Agreement shall supersede any prior promises, agreements, representations, undertakings or implications whether made orally or in writing between you and us relating to the subject matter of this agreement.

Amendment

This Agreement may not be amended except in a writing, signed by the parties. By giving my signature below, I agree and confirm:1) that I have read and understand the above Terms & Conditions and understand and accept them as legally binding; 2) that all my answers and other information included in the Application Form which I am submitting to attend the Process are true and complete as given and remain true, correct and complete at the date my signature is given, and; 3) that I did not omit anything relevant from any response or statement. I agree to notify POL Global Foundation Ltd. immediately if any of my answers change, and verify this signature to be legally binding. I acknowledge that a legally binding agreement, including all stated terms and conditions, is formed when POL Global Foundation Ltd. accepts my Registration Form.

No Signature by POL Global Foundation Ltd. of these Terms and Conditions is Required.

No signature or execution by POL Global Foundation Ltd. of these Terms and Conditions is required for them to be effective and part of our agreement. Following execution of the Terms & Conditions by you, the participant, our agreement to these Terms and Conditions is finalized by your execution thereof, and your being considered for acceptance into the program by POL Global Foundation Ltd. Acceptance of these Terms and Conditions is required from all participants, and said Terms and Conditions are accepted by POL Global Foundation Ltd without execution of this Terms and Conditions form by POL Global Foundation Ltd.
